CUSTOMERS.AI — $99 INBOXER LIFETIME DEAL TERMS & CONDITIONS

These Lifetime Deal Terms & Conditions (“LTD Terms”) govern your purchase of and access to the Customers.ai $99 Lifetime Deal (“Lifetime Deal”). By purchasing the Lifetime Deal, you agree to be bound by these LTD Terms and the Customers.ai Master Terms of Service (“MSA”), available at https://customers.ai/master-service-agreement, which are incorporated herein by reference. In the event of any conflict between these LTD Terms and the MSA, the MSA shall control.
- The Lifetime Deal
The Lifetime Deal provides access to a single designated core tool or feature of the Customers.ai Platform (“Included Feature”) for the life of the product, subject to the terms herein. The Included Feature is described at the time of purchase and does not include access to any other tools, features, or products within the Customers.ai suite. Customers.ai reserves the right to modify, update, or evolve the Included Feature at its sole discretion.
The Lifetime Deal is a one-time purchase of $99 USD and does not entitle Customer to any refund, credit, or compensation in the event the Included Feature is modified or discontinued, except as expressly stated herein.
- Eligibility
The Lifetime Deal is available exclusively to customers who meet Customers.ai’s then-current Ideal Customer Profile (“ICP”) criteria, as determined by Customers.ai in its sole discretion. Eligibility requirements may include factors such as industry, company size, use case, or geographic location, and are subject to change at any time without prior notice. Customers.ai reserves the right to decline, revoke, or cancel a Lifetime Deal purchase for any customer who does not meet the current eligibility criteria at the time of purchase or at any subsequent time.
- Lifetime of the Product
“Lifetime” refers to the period during which Customers.ai actively offers and maintains the Included Feature, and not the lifetime of the Customer. Customers.ai reserves the right to sunset or discontinue the Included Feature with reasonable prior notice to Customer. Upon discontinuation, Customers.ai’s sole obligation shall be to provide no less than 30 days’ written notice to Customer.
- Required Third-Party Integration — Klaviyo
The Included Feature requires a valid, active connection to Customer’s Klaviyo account in order to function. Customers.ai shall not be liable for any interruptions, data loss, or feature failures arising from issues with Customer’s Klaviyo account, revocation of access, or changes to Klaviyo’s platform or API. Access to Klaviyo is governed solely by Klaviyo’s own terms and conditions, and Customers.ai makes no representations or warranties regarding Klaviyo’s availability or performance.
- Acceptable Use & Suspension Rights
The Lifetime Deal is subject to fair and lawful use. Customers.ai reserves the right to suspend or terminate Customer’s access to the Included Feature, without refund, in the event of:
- Abuse of the Platform, including excessive or automated usage that places an unreasonable load on Customers.ai’s infrastructure;
- Any violation of these LTD Terms or the MSA;
- Unlawful use of the Platform or data obtained through the Platform;
- Activity that Customers.ai reasonably believes may harm its business, other users, or third parties;
- Any breach of applicable laws, including but not limited to CAN-SPAM, TCPA, GDPR, or other data privacy regulations.
Customers.ai will generally provide notice prior to suspension; however, it reserves the right to suspend access immediately where necessary to protect the integrity of the Platform or comply with applicable law. Suspension or termination due to abuse or violation shall not entitle the Customer to any refund of the purchase price.
- Marketing & Co-Promotion
Customer agrees to collaborate with Customers.ai on developing joint marketing materials, which may include case studies, testimonials, social mentions, or press releases. Any marketing content will be mutually decided and agreed upon by both parties prior to publication.
Customer grants Customers.ai permission to use Customer’s name in Customers.ai marketing materials and to publish Customer’s name, trademark, and/or logo on the Customers.ai website and in other marketing channels, solely for the purpose of identifying Customer as a Customers.ai client. Customer retains the ability to request removal of its name, trademark, or logo from Customers.ai marketing materials at any time by submitting a written request to [marketing@customers.ai], and Customers.ai will honor such request within a reasonable timeframe.
- Non-Transferability
The Lifetime Deal is personal to the Customer and may not be transferred, resold, sublicensed, or assigned to any third party without Customers.ai’s prior written consent. Any attempt to do so shall render the Lifetime Deal void and may result in immediate termination of access without refund.
- No Refunds
All purchases of the Lifetime Deal are final and non-refundable, except as required by applicable law. Please review these LTD Terms carefully before purchasing.
