1. Introduction
Customers.ai respects your privacy, and this Privacy Policy describes how we collect, use, share, and store your information. MobileMonkey, Inc. d/b/a Customers.ai (“Customers.ai,” “we,” “us”) operates the Platform and collects information from users (“you,” “your”). This Privacy Policy is incorporated into our Master Subscription Agreement and Terms of Service, and all capitalized terms not defined here have the same meanings given in those agreements. Please review this policy periodically, as we may update it. If we make material changes, we will notify you as described in Section 16. If you do not agree to this policy, you must not use the Platform.
This Privacy Policy applies to all users, including residents of states with comprehensive privacy laws, such as California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, and the District of Columbia.
2. Applicability of Privacy Policy
This policy applies to information we collect:
- On this Platform;
- Through your submission of any User Content or other communications between you and us;
- Through our identity resolution and visitor identification technologies deployed on our customers’ websites (see Section 3); or
- Through third parties and business partners, offline or through any other means, including under data licensing and data sharing agreements, as permitted by applicable U.S. state privacy laws.
3. Information We Collect About You and How We Collect It
We collect several types of information (collectively “Personal Information”) from and about users of our Platform and, in connection with the services we provide to our business customers, about visitors to and contacts of our customers’ websites, including:
- Identifiers you submit directly to us, such as your name, e-mail address, telephone number, address, payment information, and business information;
- Internet and device information collected automatically or through third parties, including IP address, device ID, cookie identifiers, local browser storage information, connection and operating system information, and Platform usage details;
- Usage data related to your email and website interactions on our Platform or our customers’ websites;
- Pseudonymized identifiers (such as hashed email addresses), associated IP addresses, and event timestamps that we receive from business partners under contractual data sharing arrangements, which we use to verify and improve our identity graph; and
- Commercial and professional information relevant to matching business contacts to our customers’ audiences.
Identity resolution. A core function of our Platform is identity resolution: at our customers’ direction, we match, link, or enrich records — for example, associating a visitor to a customer’s website with contact or profile information in our identity graph. This means we may combine information collected from different sources, including pseudonymized identifiers received from partners, to recognize a person or device across websites and over time.
Sensitive Personal Information. We do not intentionally collect or process sensitive personal information as defined under applicable state privacy laws (such as government identifiers, precise geolocation, biometric data, or health information), and we contractually prohibit our data partners from providing it to us. We do not use or disclose personal information for purposes that would require a “right to limit” under the CCPA/CPRA.
4. Cookies and Other Tracking
A cookie is a small file placed on the hard drive of your computer. We use cookies, pixels, and similar technologies to remember and identify you and to help us understand how you interact with the Platform or our customers’ websites or emails. You may refuse to accept browser cookies by activating the appropriate setting on your browser; however, some portions of the Platform or services may then not function properly. Unless you have adjusted your browser settings to refuse cookies, our system will issue cookies when you direct your browser to our Platform.
5. How We Use Your Information
We use information that we collect about you or that you provide to us, including any Personal Information:
- To make the Platform available and for you to use the Platform;
- To respond to your requests and provide you with notices about your account;
- To carry out our obligations and enforce our rights arising from any contracts between you and us;
- To notify you about changes to our Platform or any products or services we offer;
- To identify or authenticate your access and use of the Platform;
- To provide identity resolution, visitor identification, audience matching, and related services to our customers and partners, which may include using pseudonymized identifiers to recognize you through your email address or device;
- To contact you about our own and third-party goods and services that may be of interest to you, unless you have opted out;
- To honor opt-out requests and other privacy rights requests, including universal opt-out preference signals, as required by applicable state privacy laws; and
- In any other way we may describe when you provide the information, or for any other purpose with your consent.
6. Disclosure of Your Information
We may disclose aggregated or de-identified information that does not identify any individual without restriction. We may disclose Personal Information as follows:
- To our subsidiaries and affiliates;
- To contractors, service providers, and other third parties we use to support our business, bound by contractual confidentiality and data protection obligations;
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets;
- To our customers, to identify which consumers may be interested in their offerings, and to assist in targeting or retargeting marketing content and providing supplemental services such as marketing optimization, campaign management, and analytics; and
- To third parties to market their products or services to you, if you have not opted out of these disclosures.
Some of the disclosures described above may constitute a “sale” of personal information or “sharing” for cross-context behavioral advertising under applicable state privacy laws. You may opt out at any time as described in Section 7. We do not knowingly sell or share the personal information of consumers under 16 years of age.
We also reserve the right to disclose your Personal Information where necessary to comply with any court order, law, or legal process; to enforce our agreements; or where we believe disclosure is necessary to protect the rights, property, or safety of Customers.ai, our partners, our customers, or others, including for fraud protection and credit risk reduction.
7. Your Privacy Rights and Choices
Depending on your state of residence, you may have the following rights regarding your personal information:
- Right to Know/Access – request access to, and a portable copy of, the personal information we have collected about you, including the categories of sources and the categories of third parties to whom it was disclosed, sold, or shared;
- Right to Correct – request correction of inaccuracies in your personal information;
- Right to Delete – request deletion of your personal information, subject to legal exceptions;
- Right to Opt Out – opt out of the sale or sharing of personal information and of targeted advertising; and
- Right to Appeal – in certain states, appeal our decision regarding your privacy request by replying to our response or emailing info@customers.ai with the subject line “Privacy Appeal.”
How to exercise your rights. You may submit a request by emailing info@customers.ai or by using the “Do Not Sell or Share My Personal Information / Your Privacy Choices” link on our website. We will verify your request using the email address associated with the personal information at issue (and additional information where necessary), and we will respond within 45 days, with one 45-day extension where reasonably necessary and with notice to you. You may designate an authorized agent to submit requests on your behalf; we may require proof of the agent’s authority and verification of your identity. We will not discriminate against you for exercising your rights.
Universal opt-out signals. We recognize and honor opt-out preference signals, such as the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information linked to your browser, as required by applicable state privacy laws.
Additional choices:
- Tracking Technologies. You can set your browser to refuse all or some cookies or to alert you when cookies are being sent; some parts of the site may then not function properly.
- Targeted Advertising. You may opt out of interest-based advertising by industry participants at http://www.aboutads.info/choices and https://optout.networkadvertising.org.
- Offers from Our Customers. If you do not wish to have your Personal Information used by our customers, you can opt out using the unsubscribe or opt-out links they provide, or by contacting us at info@customers.ai and we will apply a suppression.
8. Data Broker Disclosures
To the extent Customers.ai qualifies as a “data broker” under applicable state laws (including the California Delete Act, and the data broker registration laws of Texas, Oregon, and Vermont), we register and maintain the required disclosures in each applicable jurisdiction. California residents may also request deletion of their personal information from all registered data brokers, including us, through the California Privacy Protection Agency’s Delete Request and Opt-Out Platform (DROP); we process verified deletion requests received through that mechanism as required by law.
9. Data Retention and Deletion
We retain personal information for as long as necessary to fulfill the purposes for which it was collected or as required by applicable laws. The retention period for each category of personal information is determined by the purpose of processing, the sensitivity of the information, our legal and contractual obligations (including contractual commitments to truncate or delete certain identifiers, such as IP addresses received from data partners, within fixed periods), and applicable limitation periods. Users can request deletion of their data at any time by emailing info@customers.ai or as described in Sections 7 and 8.
10. Third-Party Use of Cookies and Other Tracking Technologies
The Platform uses third-party cookies and other tracking applications. Some content or applications are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with other tracking technologies to collect information about you or your customers over time and across different websites and online services. We do not control these third parties’ tracking technologies. You can opt out of receiving targeted ads from members of the Network Advertising Initiative at https://optout.networkadvertising.org.
Google Workspace APIs are not used to develop, improve, or train generalized AI and/or ML models.
11. California Users
California’s “Shine the Light” law (Civil Code § 1798.83) permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, or to exercise your rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act, please email info@customers.ai or see Sections 7 and 8 above.
12. Opt-Out Preference Signals and “Do Not Track”
As described in Section 7, we honor the Global Privacy Control and similar legally recognized opt-out preference signals as a request to opt out of the sale or sharing of personal information. Legacy browser “Do Not Track” signals that do not meet the requirements of applicable state privacy regulations are not treated as opt-out requests. 13. Data Security
We use industry standard measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure, including encryption of personal information in transit and at rest, role-based access controls with multi-factor authentication, and regular security reviews. Unfortunately, the transmission of information via the internet is not completely secure, and we cannot guarantee the security of Personal Information transmitted to our Platform; any transmission is at your own risk.
14. Children Under the Age of 18
Our Platform is not intended for anyone under 18 years of age, and no one under 18 may provide any information to or on the Platform. We do not knowingly collect Personal Information from children under 18, we do not knowingly sell or share the personal information of consumers under 16, and we contractually require our data partners to exclude data of individuals known to be minors. If we learn we have collected Personal Information from a child under 18, we will delete it. If you believe we might have any information from or about a child under 18, please contact us at info@customers.ai.
15. Changes to Our Privacy Policy
Our Platform is not intended for anyone under 18 years of age, and no one under 18 may provide any information to or on the Platform. We do not knowingly collect Personal Information from children under 18, we do not knowingly sell or share the personal information of consumers under 16, and we contractually require our data partners to exclude data of individuals known to be minors. If we learn we have collected Personal Information from a child under 18, we will delete it. If you believe we might have any information from or about a child under 18, please contact us at info@customers.ai.
16. Non-US Users
The Platform is operated from the United States and is intended for users located in the United States. We do not intentionally collect or process personal data of individuals located in the European Economic Area, the United Kingdom, or Switzerland. If you access the Platform from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where privacy laws may not be as protective as those in your jurisdiction, and such information will be collected, processed, stored, disclosed, and disposed of in accordance with applicable United States law.
